Terms of service

These terms are an agreement between MadFish Solutions, LLC (“MadFish”, “we”) and the business that subscribes to Black Beach POS (“you”, the “store”). By creating an account or using the service you agree to them.

The service

Black Beach POS is point-of-sale and inventory software for retail stores, delivered as a subscription. It includes the register, inventory, purchasing, customers and the BigCommerce integration described on this site, and support from MadFish.

Your responsibilities

• You are responsible for the accuracy of what you enter, for collecting and remitting the sales taxes your store owes, and for complying with the laws that apply to your business.
• Card payments at the counter are processed by your own payment processor under your agreement with them. Black Beach POS records payment outcomes; it does not process cards.
• You will keep your sign-in details and cashier PINs confidential and will use the service only for lawful business purposes.
• You will not attempt to access other stores’ data, reverse engineer the service, or resell it.

Subscription, trial and billing

• Plans are monthly and billed in advance through Stripe. A free trial converts to a paid plan at its end unless you cancel first; nothing is charged during the trial.
• You may change plans or cancel at any time from your billing portal. Cancellation takes effect at the end of the current billing period, and no partial-month refunds are given unless the law requires them.
• If a payment fails we will tell you and retry. After repeated failures the account may be paused until payment is completed. Your data is kept while paused.
• Prices may change with at least 30 days’ notice by email; the change applies from your next renewal after the notice period.

Your data

• You own the data you put into Black Beach POS. We process it only to provide the service, as described in our Privacy policy.
• You can export your catalog, stock, sales and customers at any time in standard formats, without charge.
• After termination we keep your data for 30 days for export and then delete it, except where we are required by law to keep it longer.

Integrations

Connecting a third-party service such as BigCommerce, Flxpoint or ShipStation is your choice and subject to that service’s own terms. We exchange only the data needed for the integration and only while it is enabled. We are not responsible for changes those services make.

Availability and support

We aim for the service to be available at all times, with maintenance announced in advance where practical. Support is included with every plan and answered by email and in-app chat, normally within one business day.

Warranty and liability

The service is provided as described on this site. To the extent the law allows, we disclaim other warranties, and our total liability to you for any claim is limited to the fees you paid us in the twelve months before the claim arose. We are not liable for indirect or consequential loss, including lost sales.

Ending the agreement

You may end it by cancelling your subscription. We may suspend or end your subscription if you materially breach these terms and do not cure the breach within 14 days of notice, or if required by law. On ending, the data terms above apply.

General

These terms are governed by the laws of the State of Ohio, USA. If any part is found unenforceable the rest stands. We may update these terms with 30 days’ notice by email; continuing to use the service after that is acceptance.
